MyAcumen

Terms and Conditions

Version: 2.2
Last Updated: October 2026

1. Introduction

1.1 These Terms and Conditions of Sale (“Terms”) govern the sale of online assessment, coaching and team diagnostic services by MyAcumen (“we”, “us”, “our”) to you, the customer (“you”, “your”).

1.2 By purchasing any services from our website or platform, you agree to be bound by these Terms. If you do not agree, you should not proceed with any purchase.

2. Services Covered

2.1 These Terms apply to all services offered by us, including:

For individuals

  • MyAcumen Complete, which includes:
    • Skills assessments (Core Skills, and Role Skills for your role in a commercial environment)
    • Motivator assessment (drivers, values, and engagement factors)
    • TrustBuilder personality style assessment
    • 360-degree feedback (from people you nominate)
    • Reports drawn from your results, including a personal analysis report
    • Mya, our AI coach, in the app (see Section 8)
    • Follow-up emails and an open monthly call with MyAcumen
  • Coaching top-ups for Mya (see Section 8)

For teams

  • The MyAcumen Team Diagnostic: every team member takes MyAcumen Complete, and we analyse the results, produce a team report and dashboard, and deliver a live Executive Debrief. The Team Diagnostic is bought through a proposal we agree with you.

2.2 All services are delivered digitally via our platform.

2.3 We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. What MyAcumen Assessment Is and Isn’t

3.1 MyAcumen assessment is a diagnostic tool designed to provide clarity on capability, strengths, blind spots, and development priorities. It is not:

  • A guaranteed pathway to transformation or career advancement
  • Professional, legal, financial, or psychological advice or diagnosis
  • A substitute for medical, therapeutic, or psychiatric evaluation
  • A performance appraisal, performance management tool, or employment assessment for hiring decisions
  • A guarantee of capability or job suitability

3.2 Assessment outputs are intended for informational purposes and personal or organisational development planning only.

3.3 Results are confidential and for the assessment participant’s use. Except as set out in 3.4, we do not disclose individual assessment results to third parties without explicit written consent, except where required by law.

3.4 Team Diagnostic: Where your organisation buys a Team Diagnostic, the sales leader or project lead sees every participant’s individual results. Other managers given access see individual results only for their own team. The team report never names an individual, and 360-degree feedback comments are never included in team results. On small teams, results may be identifiable, and the invitation to take part says so.

4. 360-Degree Feedback Process

4.1 As part of your assessment, you will nominate individuals (typically managers, peers, customers/partners and direct reports) to provide confidential feedback on your capability and behaviour.

4.2 When you nominate a feedback provider:

  • We will provide you with a unique code and link that you can share with others to complete a confidential feedback survey on your behalf
  • Feedback providers remain anonymous to you (you see themes and patterns, not individual responses)
  • Feedback providers will not see your assessment results unless you choose to share them

4.3 Your specific and granular feedback data is used solely to generate your personalised report and is not shared with third parties unless you choose to share it. Your data may be used to compile Team Diagnostic reports where you take part in a Team Diagnostic.

4.4 By nominating a feedback provider, you confirm:

  • You have their permission to request feedback
  • They have agreed (or you will gain agreement) to participate
  • You understand their feedback will be confidential

4.5 We recommend you brief feedback providers on the purpose of the assessment and reassure them of anonymity before they receive their invitation.

5. Ordering and Acceptance

5.1 All orders for services are subject to availability and our acceptance.

5.2 We will confirm acceptance of your order by email within one working day, at which point a contract between you and MyAcumen is formed.

5.3 You must ensure all information provided in your order is accurate and complete. You are responsible for the accuracy of any assessment data you provide (responses and feedback nominator details).

5.4 We reserve the right to refuse or cancel an order if it appears you intend to misuse the service or breach these Terms.

6. Pricing and Payment

6.1 All prices are paid in GBP (£) and include VAT unless stated otherwise.

6.2 Euro and US Dollar pricing is calculated at the prevailing exchange rate on the day, but payment is always taken in GBP.

6.3 Payment must be made in full at the time of purchase via our accepted payment methods, or if you select a payment plan option, you are committing to pay all installments.

6.4 We reserve the right to change pricing with reasonable notice.

6.5 If you are purchasing an assessment on behalf of a team member or direct report, you remain responsible for payment and acceptance of these Terms.

7. Assessment Delivery and Timelines

7.1 After purchase, you will receive:

  • Immediate access to your assessment platform and login credentials
  • Instructions to complete the assessments in your own time
  • Where purchased: A secure link to nominate your 360-degree feedback providers

7.2 Your comprehensive diagnostic report will be available immediately upon completion of the assessment. With the exception of 360 feedback, which waits to aggregate 3 or more responses, so the report will be available once this threshold is reached.

7.3 Reports are delivered digitally via your account dashboard.

7.4 Team Diagnostic: We agree the timeline with your project lead when the project is set up. The Executive Debrief is arranged with your project lead once the team’s assessments are complete.

8. Mya, our AI coach

8.1 MyAcumen Complete includes Mya in the app, with two modes: Explain my results, with 50 questions about your results, and Coach me, with 5 free coaching conversations. Neither expires.

8.2 Coaching top-ups add 10 coaching conversations and 10 results questions. They are bought in the app at the price shown there, and they never expire.

8.3 In a Team Diagnostic, every team member gets Mya as part of MyAcumen Complete. The buyer also gets Project Mya, a shared allowance of 200 questions about the team’s results, which never expires.

8.4 We do not guarantee continuous, uninterrupted access to Mya or the platform, but will use reasonable efforts to maintain availability. We reserve the right to suspend services for maintenance, security, or legal reasons.

8.5 Your access is for your own use. You may not share login credentials or sell access to others.

9. Refunds and Cancellations

9.1 Assessments (MyAcumen Complete for individuals): Digital assessment services are non-refundable once accessed or begun, in accordance with the Consumer Contracts Regulations 2013.
However, if the assessment is faulty, significantly not as described, or you genuinely learned nothing, talk to us within 14 days to request a refund. Book a brief call to discuss what you were hoping for and where the assessment fell short. If we agree the assessment failed to deliver, we’ll process a full refund.

9.2 Team Diagnostic: The 14-day refund in 9.1 does not apply. Team Diagnostic services are non-refundable once the project has started.

9.3 Coaching Top-ups: An unused coaching top-up can be refunded within 14 days of purchase. Your conversations are available straight away, and once you have used any of them, the top-up is non-refundable. You agree to this when you buy.

9.4 If you believe you are entitled to a refund or have concerns about a purchase, contact us at hello@myacumen.online with details within 14 days of purchase.

10. Intellectual Property

10.1 All assessment content, frameworks, methodology, reports, and materials are owned by MyAcumen, including the proprietary Value Builder Selling System methodology.

10.2 Your assessment results and report may be used for your own development and professional purposes.

10.3 You may not reproduce, share, modify, commercially exploit, or reverse-engineer any MyAcumen content, frameworks, or assessment materials without prior written permission.

10.4 Sharing your report in full with a manager, coach, or mentor for development purposes is permitted. Mass sharing or publication is not.

11. User Conduct and Data Security

11.1 You agree to use MyAcumen services lawfully and not to:

  • Misrepresent your identity or another person’s identity
  • Provide false information or attempt to bypass assessment integrity measures
  • Engage in unlawful, harmful, abusive, or discriminatory behaviour
  • Attempt to access other users’ data or reports
  • Publish or share others’ assessment results without consent

11.2 We reserve the right to suspend or terminate your access to our services if you breach these Terms or engage in prohibited conduct.

11.3 We implement reasonable security measures to protect your assessment data and personal information. You are responsible for keeping your login credentials confidential.

12. Limitation of Liability

12.1 We do not guarantee that MyAcumen assessment will identify all capability gaps, meet your specific development needs, or guarantee any particular outcome or career advancement.

12.2 To the maximum extent permitted by law, MyAcumen shall not be liable for:

  • Any indirect, consequential, incidental, or lost profit damages
  • Decisions you make based on your assessment results
  • Career, employment, or business outcomes resulting from use of the assessment
  • Any loss or misuse of data, even if we have been advised of the possibility

12.3 Our total liability for any claims arising from these Terms shall not exceed the amount you paid for the relevant service.
